Technicality
Pursuant to Sec. 1 (1) Patent Law, technicity is a prerequisite for patentability which is rarely addressed in the case of "ordinary" inventions. The situation is completely different when patent protection is sought for software-based inventions.
While software engineers naturally see themselves as "technicians" and the rapidly growing possibilities of data processing technologies are being used in more and more areas of science and everyday life, the question whether problem solutions realized by software are "technical in nature" and thus patentable still causes difficulties, at least in German patent law.
